Please read these terms carefully before using TIQFiT. They describe your rights and responsibilities as a user or business owner, and govern your use of our platform — including AI-powered tools, GPS features, lead generation, and media uploads.
These Terms of Service ("Terms") govern your access to and use of TIQFiT ("we", "us", or "our"), India's sports and fitness business listing and discovery platform. These Terms apply to all users, business owners, and visitors of the Platform, including use of AI-powered listing tools, GPS location features, lead generation, and cloud media storage.
1. Acceptance of Terms
By accessing or using TIQFiT ("the Platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the Platform.
These Terms apply to all visitors, registered users, and business owners who use TIQFiT, including its AI-powered listing assistant, GPS location tools, lead generation features, and cloud media services.
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you via the Platform or by email. Continued use of TIQFiT after any changes constitutes your acceptance of the revised Terms.
2. Eligibility
You must be at least 13 years of age to use TIQFiT as a general user. To submit or manage a business listing, you must be at least 18 years of age or have the explicit consent of a parent or legal guardian.
By using TIQFiT, you represent and warrant that you meet the applicable age requirements and have the legal capacity to enter into a binding agreement under these Terms.
3. User Accounts & OTP Authentication
TIQFiT uses OTP-based (One-Time Password) mobile number verification for account creation and login. No passwords are stored. You are responsible for keeping your OTP private and must not share it with anyone.
You are responsible for all activities that occur under your account, whether or not authorised by you.
You must notify us immediately at help@tiqfit.com if you suspect any unauthorised access to your account.
You must not create multiple accounts for the purpose of circumventing platform rules or restrictions.
We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behaviour.
Changing Your Phone Number: To update the mobile number linked to your account, contact us at help@tiqfit.com with a valid identity verification. Phone number changes are subject to manual review to prevent fraud.
4. Platform Use
TIQFiT is a sports and fitness business listing and discovery platform. We do not directly provide sports coaching, gym services, or fitness training, and we are not responsible for the quality, safety, or conduct of any business or individual listed on the Platform.
You agree to use TIQFiT only for lawful purposes and in accordance with these Terms. You must not:
Submit false, misleading, or fraudulent business listings or reviews.
Impersonate any business, person, or entity, or misrepresent your affiliation with any organisation.
Use automated tools, bots, or scripts to scrape, crawl, or harvest data from the Platform.
Interfere with or disrupt the Platform's servers, networks, or security systems.
Use the Platform to spam, harass, abuse, or harm other users or businesses.
Attempt to gain unauthorised access to any part of the Platform or another user's account.
Misuse the AI listing assistant by submitting content that is unlawful, defamatory, or intentionally false.
5. Business Listings
Businesses and individuals who list their sports or fitness services on TIQFiT represent that all information provided — including business name, address, contact details, category, programs, fees, and service descriptions — is accurate, current, and complete.
TIQFiT reviews listings before publishing them, but does not independently verify every claim. Users are encouraged to conduct their own due diligence before visiting or engaging with any listed business.
We reserve the right to reject, edit, or remove any business listing at any time if it violates these Terms, our content standards, or is found to contain misleading or harmful information.
Listing on TIQFiT does not constitute endorsement or certification of any business by TIQFiT.
6. AI Listing Assistant
TIQFiT offers an AI-powered listing assistant that helps business owners extract structured details from raw text. By using this feature, you acknowledge and agree to the following:
The raw text you paste into the AI assistant is transmitted to Groq, a third-party AI infrastructure provider, for processing. By using this feature, you consent to this transmission under Groq's applicable terms.
The AI output is a suggestion only. You are solely responsible for reviewing, correcting, and verifying all AI-prefilled information before submitting your listing.
TIQFiT is not liable for inaccuracies, errors, or omissions in AI-generated content. Any incorrect information published as a result of unreviewed AI output is your responsibility as the listing owner.
Do not paste sensitive personal information (e.g. Aadhaar numbers, bank details, personal IDs) into the AI assistant.
7. Business Claiming
TIQFiT allows registered users to claim ownership of a business listing that was created without prior ownership verification (e.g. seeded or submitted by a third party).
To claim a listing, you must submit a claim request. TIQFiT will review your claim and may contact you to verify your identity and association with the business. Approval of a claim is at TIQFiT's sole discretion.
You must not submit a false or fraudulent business claim. Doing so may result in immediate account suspension and legal action.
Once a claim is approved, you assume full responsibility for maintaining the accuracy and compliance of the listing.
8. Lead Generation & Contact Reveal
TIQFiT allows users to reveal a business's contact number by completing their user profile. By completing your profile and revealing a contact number, you explicitly consent to the following:
Your name and contact information will be recorded as a lead and shared with the relevant business.
The business may contact you using the information you provided.
Businesses receiving lead information must use it solely to respond to genuine user interest. Leads must not be sold, shared with third parties, or used for unsolicited bulk marketing.
TIQFiT is not responsible for how businesses use the lead information beyond the platform. If you experience misuse, contact us at help@tiqfit.com.
9. GPS & Location Features
When listing a business, TIQFiT offers a GPS "Use my current location" feature that accesses your device's location via the browser Geolocation API. Use of this feature is entirely optional and requires your explicit browser permission.
Coordinates you provide (via GPS or map click) are sent to OpenStreetMap's Nominatim service for reverse geocoding to auto-suggest address fields. This is a one-time, functional request tied to your map interaction.
Location data obtained through this feature is used only to set your business pin on the map. It is not tracked passively or stored independently of your listing.
You may deny location permission at any time and manually enter or adjust your location on the map instead.
10. Media Uploads & Image Content
Business owners may upload photos and images to their listings. By uploading media to TIQFiT, you represent and warrant that:
You own the content or have the necessary rights and permissions to upload and display it.
The content does not infringe any third-party intellectual property, privacy, or other rights.
The content does not contain inappropriate, offensive, or illegal material.
Uploaded images are stored on DigitalOcean Spaces (a cloud CDN). By uploading content, you grant TIQFiT a non-exclusive, royalty-free licence to display the media as part of your listing for as long as it remains active on the Platform.
TIQFiT reserves the right to remove any uploaded media that violates these Terms. Images are deleted from cloud storage when a listing is permanently removed.
11. User Responsibilities
Users searching for sports and fitness businesses on TIQFiT are responsible for their own safety and must exercise appropriate caution when visiting or engaging with any listed business.
Any arrangements, bookings, memberships, payments, or agreements made between users and listed businesses are solely between those parties. TIQFiT is not a party to such arrangements and accepts no liability for their outcome.
TIQFiT does not process payments between users and businesses. All financial transactions are handled directly between you and the business.
12. Reviews & User Content
Users may submit reviews, ratings, and other content on TIQFiT. By submitting content, you grant TIQFiT a non-exclusive, royalty-free licence to use, display, and moderate that content on the Platform.
Reviews must be honest, based on genuine first-hand experience, and must not contain defamatory, offensive, misleading, or fabricated content.
We reserve the right to remove any review or user-submitted content that violates these Terms or our community standards.
Businesses must not attempt to manipulate reviews by incentivising positive reviews, submitting fake reviews, or reporting genuine reviews maliciously.
13. Intellectual Property
All content on TIQFiT — including the brand name, logo, design, software, platform features, and AI tools — is the property of TIQFiT or its licensors and is protected under applicable intellectual property laws of India.
You may not copy, reproduce, redistribute, reverse-engineer, or create derivative works from TIQFiT content or platform code without our express prior written permission.
Business owners retain ownership of the content they submit (photos, descriptions, programs, etc.) but grant TIQFiT a licence to display it as part of their active listing.
14. Disclaimer of Warranties
TIQFiT is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will always be uninterrupted, error-free, or free of technical issues.
We do not guarantee the accuracy, completeness, or reliability of any business listing, AI-generated content, review, or user-submitted content on the Platform. Always verify details directly with the business before making any decisions.
AI-generated content from the listing assistant is provided as a convenience tool and does not represent verified or guaranteed information.
15. Limitation of Liability
To the maximum extent permitted by applicable Indian law, TIQFiT shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the Platform.
TIQFiT is not liable for any loss or damage arising from your reliance on AI-generated listing content, information in any business listing, GPS or geocoding data, or from any direct dealings between you and a listed business.
Our total liability to you for any claim arising from these Terms or your use of TIQFiT shall not exceed ₹1,000 or the amount you have paid us in the 12 months preceding the claim, whichever is greater.
16. Termination
We may suspend or terminate your access to TIQFiT at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or engaged in conduct harmful to the Platform or its users.
Upon termination, your right to use the Platform ceases immediately. Business listings and media associated with a terminated account may be removed.
You may delete your account or request removal of your business listing at any time by contacting us at help@tiqfit.com.
17. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
Any disputes arising out of or in connection with these Terms or your use of TIQFiT shall first be attempted to be resolved amicably. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.
